These Terms and Conditions ("Terms") govern your access to and use of:
• The Safood website safood.co (the "Site"); and
• The Safood POS and Restaurant Management System, including related mobile apps, modules, and services (collectively, the "Service"),
provided by Safood / DatumDigi Solutions, a company established in the Kingdom of Saudi Arabia ("Safood", "we", "us", "our").
By creating an account, accessing, or using the Site or Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Site or Service.
If you have a separate written agreement with us (e.g., a subscription agreement or master services agreement), that agreement will prevail over these Terms in the event of any conflict, but these Terms will still apply to your general use of the Site and platform.
2.1 Eligibility
The Service is intended for lawful business use by restaurants, cafés, and similar entities. By using the Service, you represent that:
• You are at least 18 years old; and
• You have the authority to bind the business or organization on whose behalf you are registering.
2.2 Account Creation
To use the Service, you may need to create an account and provide certain information (business name, contact details, etc.). You agree to:
• Provide accurate, current, and complete information;
• Keep your login credentials secure and confidential;
• Promptly update your information if it changes.
You are responsible for all activities that occur under your account, including actions by your staff or any person to whom you provide access.
Safood provides a POS and restaurant management platform, which may include:
• Order and billing management;
• Table and menu management;
• Inventory and stock tracking;
• Staff and shift management;
• Basic analytics and reporting;
• Integration with payment gateways and/or third party tools.
We may:
• Add, modify, or remove features from time to time;
• Provide different service plans with varying functionality and limits;
• Release updates, bug fixes, or enhancements without prior notice.
The specific features, limits, and service levels applicable to you may be described on our Site, within the Service, or in a separate written agreement.
• Access to the Service may be provided on a subscription basis (e.g., monthly or yearly).
• Fees, billing cycles, and payment terms will be specified at the time of subscription or in a separate agreement.
• You authorize us or our payment processor to charge the applicable fees using your chosen payment method.
• All fees are generally non-refundable unless expressly stated otherwise or required by law.
We may suspend or limit your access to the Service if fees remain unpaid after the due date.
All prices may be shown in Saudi Riyals (SAR) and may be subject to applicable taxes (e.g., VAT) under Saudi law.
You agree not to use the Site or Service:
• In any way that violates Saudi law, public order, public morals, or Islamic values;
• To store or transmit any content that is unlawful, offensive, defamatory, or infringing;
• To introduce viruses, malware, or harmful code;
• To attempt to gain unauthorized access to any systems, networks, or data;
• To reverse engineer, decompile, or interfere with any part of the Service;
• To send spam or unauthorized marketing messages using the Service;
• To collect or process personal data in violation of the PDPL or without proper legal basis and consents.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.
Your Business Data
You (the Business Customer) retain ownership of the data you input into the Service, including:
Menu items, prices, business settings;
Order history, transaction data;
Customer and staff information.
You grant Safood a non-exclusive, worldwide, royalty-free license to host, store, process, and use this data solely to:
Provide and improve the Service;
Comply with legal obligations;
Perform analytics in aggregated or anonymized form (not identifying you or your customers directly).
Compliance with Law
You are responsible for:
Ensuring that your collection and use of personal data (e.g., customer contact details) comply with PDPL and any other applicable law;
Obtaining any required consents from your customers or staff before using their data in the Service;
Configuring the Service and your internal processes in a compliant manner.
For data you provide about your restaurant customers and staff, you are the Controller and Safood generally acts as a Processor.
We will process such data only in accordance with your instructions, our Privacy Policy, these Terms, and any separate data processing agreement if applicable.
We implement appropriate security measures to protect personal data, as described in our Privacy Policy.
If you receive a data subject request (e.g., access or deletion) from your customer or staff relating to data in Safood, you should handle it as Controller. We will assist you as reasonably required and permitted by law.
Safood's IP
The Service, Site, software, code, design, logos, and all related intellectual property rights are owned or licensed by Safood and protected by applicable laws.
Except as expressly permitted, you must not:
• Copy, modify, adapt, translate, or create derivative works based on the Service or Site;
• Rent, lease, sublicense, or otherwise transfer your access to the Service to a third party;
• Remove or alter any copyright, trademark, or proprietary notices;
• Use the Safood name or logo without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription term, strictly in accordance with these Terms and any applicable agreement.
Feedback
If you provide feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
The Service may integrate with or link to third party services, such as:
• Payment gateways;
• Accounting tools;
• Delivery platforms;
• SMS or email services.
Your use of third party services is subject to their own terms and privacy policies, which you must review and accept. We are not responsible for:
• The availability, performance, or security of third party services;
• Any loss or damage arising from your use of them.
We aim to keep the Service available and functioning smoothly, but:
• We do not guarantee uninterrupted or error-free operation;
• The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control.
We may provide support via email, in-app chat, or other channels during our published support hours. The scope and level of support may depend on your subscription plan or separate agreement.
To the fullest extent permitted by Saudi law:
• The Site and Service are provided "as is" and "as available";
• We make no warranties or representations, express or implied, about the accuracy, reliability, fitness for a particular purpose, or non-infringement of the Service or any content;
• We do not guarantee that the Service will meet all of your requirements or be free from errors or interruptions.
Any reliance on the Site or Service is at your own risk.
To the fullest extent permitted by Saudi law:
• Safood, its shareholders, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, revenue, data, or business opportunity, arising out of or in connection with your use of the Site or Service;
• Our total aggregate liability for any claim relating to the Site or Service under these Terms shall not exceed the higher of:
• [SAR amount, e.g., SAR 5,000], or
• The total subscription fees you paid to us for the Service during the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability where such limitation is not permitted under applicable Saudi law.
You agree to indemnify, defend, and hold harmless Safood, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
• Your use of the Site or Service;
• Your violation of these Terms;
• Your violation of any third party rights;
• Your non-compliance with PDPL or other applicable laws in connection with data you input into the Service.
• These Terms apply from the time you first access the Site or Service and remain in force while you use them.
• We may suspend or terminate your access if you:
• Breach these Terms or applicable law;
• Fail to pay fees when due;
• Misuse the Service or create security risks.
Upon termination:
Your right to access the Service will cease;
We may retain or delete your data according to our Privacy Policy and legal obligations;
Certain provisions that by their nature should survive (e.g., Intellectual Property, Limitation of Liability, Indemnification, Governing Law) will continue to apply.
You are responsible for exporting any data you wish to keep before your subscription or access ends, if such export features are available.
These Terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia.
Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or the Service shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia, and you irrevocably submit to their jurisdiction.
We may update or modify these Terms from time to time. When we do, we will:
• Post the updated Terms on the Site; and
• Update the "Last updated" date at the top.
Your continued use of the Site or Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Site and Service.
